قَالَ اللَّهُ جَلَّ و عَلَا: ﴿وَإِنِ امْرَأَةٌ خَافَتْ مِنْ بَعْلِهَا نُشُوزًا أَوْ إِعْرَاضًا فَلَا جُنَاحَ عَلَيْهِمَا أَنْ يُصْلِحَا بَيْنَهُمَا صُلْحًاۚ وَالصُّلْحُ خَيْرٌۗ وَأُحْضِرَتِ الْأَنْفُسُ الشُّحَّۚ وَإِنْ تُحْسِنُوا وَتَتَّقُوا فَإِنَّ اللَّهَ كَانَ بِمَا تَعْمَلُونَ خَبِيرًا﴾ النساء (128).

Applying for a Divorce/ Separation (Khula/ Faskh)
European Islamic Council has the right to revoke a Certificate of Divorce (Faskh) we have issued, if it comes to our attention that there had been false or misleading statements or the deliberate withholding of information to obtain a separation. The Shari’ah does not permit such means to achieve a separation.
Please ensure all information provided is truthful and the Council is updated should any information (contact or other) change during the course of the case.
The evidence must be strong, valid and fair in order for us to make a decision.
The wife can obtain the advice of the European Islamic Council in advance for a very small amount, and this makes the wife aware in advance of the quality of the future decision of her case.
This also depends on the accuracy of the information provided to us.
The husband can obtain a request to stop or close the case, but only through the wife.
The request to close the case cannot be accepted by the husband alone without the wife's consent.

The Qur’an, the authentic Sunnah, consensus and analogy. As well as the sources of legislation: such as consent, the public interest, withholding pretexts, desirability, custom, and the doctrine of the Companion. This is in accordance with its conditions and the rules of Islamic jurisprudence that scholars know, especially if its adoption is in the interest of the Muslim family.
Our methodology depends mainly on considering the well-known schools of jurisprudence and other doctrines of scholars as a great jurisprudential wealth, and we choose among them what is valid and beneficial evidence.
• Taking into account the correct jurisprudential reasoning in the fatwas related to divorce issues, knowing the reality, and taking into account the facilitation for Muslims.
• The necessity of observing the purely Islamic Shari'a objectives and avoiding forbidden tricks that conflict with the realization of objectives.
The method of the European Islamic Council in issuing fatwas and decisions
Fatwas and resolutions are issued in the name of the European Islamic Council with its official seal and the signature of the Director General.
The Constitution of the Council stipulates that each of its members must fulfill the following conditions:
He must have an Islamic university degree, or be a member of the jurisprudential councils of scholars, or he graduated from their hands, and he must be familiar with the classical Arabic language and its rules. And memorizers of the Noble Qur’an, and to be famous for his good behavior and adherence to the provisions and etiquette of Islam. And to be famous for the validity of his jurisprudential conclusion. And not to accuse him of exaggeration or intellectual extremism. And to maintain prayer and recitation of the Qur'an.
And to be residing in the European arena and familiar with the situation of Muslims there.
It should be a mixture of Islamic jurisprudence, knowledge and agreement with reality.
God is the only one who grants success
* You must attach the main reasons for filing for divorce.

The husband will be informed of the case.
* In the case of reconciliation, the wife has the right to request that the case be closed.
The wife can request an extension of the case to try to reconcile the spouses.
If the wife does not respond to reconciliation because of her hatred of married life, the decision will be in her favour.
If the husband refuses to respond to the case or follow it up, the council has the right to issue a decision in favor of the wife.
The termination of the Islamic marriage contract is by annulment.
We will send some forms to the front of the case and all information must be written clearly.
If any information is hidden to mislead the council, the case will be closed in favor of the husband.
