Khul’ is: the separation of the spouses in return for a compensation to be paid by the wife to her husband, so the husband takes the compensation and separates from his wife, whether this compensation is the dowry that he paid her, or more or less than that, or the judgment is passed on it.The evidence for this is from the Sunnah of the Prophet that the wife of Thabit bin Qais bin Shammas, may God be pleased with him, came to the Prophet, may God bless him and grant him peace, and said: O Messenger of God, Thabit bin. Qais I don't blame him on morals or religion, but I hate infidelity in Islam. The Prophet, may God’s prayers and peace be upon him, said to her: Will you return to his garden for him? The garden was a dowry for her in return for marriage. The woman said yes.The Prophet, may God’s prayers and peace be upon him, said to her husband: “Take the garden and divorce her.” Narrated by Al-Bukhari (5273).So the scholars took from this issue: that if a woman is not able to stay with her husband, she has the right to ask for khul’.The husband takes the compensation or they agree on it, then he says to her: You are divorced, or you accepted your separation in return for that.
